Pawsitive Adventure Crew in Nashville, Tennessee’s Terms and Conditions.

Terms + Conditions

Client will not provide any fringe benefits, such as health insurance and paid vacation for the benefit of Pawsitive Adventure Crew’s Dog Walkers/Sitters. Pawsitive will not confirm any booking until a Meet & Greet has been carried out with The Client, proof of up-to-date vaccinations has been provided, and these terms, with full details of client requirements, has been signed by The Client in their Time To Pet Client Account.

 
 

General

Pawsitive Pet Care, LLC DBA Pawsitive Adventure Crew staff members will provide Dog Walking and Pet Sitting Services in the following manner:

  • Pawsitive Walkers/Sitters shall notify The Client of any occurrence regarding the pets which may be important to their care and well-being, either by the report card through Time To Pet (TTP) or by its messaging system. In the event of an emergency, please see the Emergencies & Liabilities section.

  • Pawsitive Walkers/Sitters shall perform the agreed-on services in an attentive, reliable and caring way and The Client does hereby agree to provide all the necessary information to assist Pawsitive Walkers/Sitters in this performance.

  • Pawsitive will walk on all holidays, but those must be scheduled before the 5th of the month or by the deadline date specified on the monthly Client Updates + News newsletter. Pet Sitting is scheduled by “first come, first served” and we only offer a limited number of slots for Holiday Visits. Holiday Visits include New Year's Eve, New Year's Day, Martin Luther King Jr. Day, President's Day, Easter, Memorial Day, Independence Day, Labor Day, Veterans Day, Halloween, Thanksgiving, Christmas Eve, and Christmas Day.

  • Pawsitive reserves the right to change pricing of services as needed, with reasonable notice to the clients. Current pricing can be found at https://pawsitivepal.com/dog-walking-in-nashville & https://pawsitivepal.com/pet-sitting-in-middle-tennessee.

  • Pawsitive reserves the right to cancel the contract at any time & with immediate effect if the dog does not respond well to Pawsitive Walkers/Sitters and/or other dogs.

 

Services

Dog Walking Services?

  1. Dog Walking Services are 30 minutes and 60 minutes for Individual Dog Walks, 30 minutes for Puppy Potty Break visits, 20 minutes for Dog Running, and 2-3 hours for Group Adventures (drive time, 60 minute walk, drive time).

  2. New Clients go through 15-30 days of mandatory Individual Walks so the walker can establish a bond with the dog, evaluate how the dog behaves in various situations, and whether the dog is a good candidate for Group Adventures. Pawsitive does not guarantee that every dog will be accepted into Group Adventures, and The Client understands that if accepted, they may be placed on a waiting list until room in Group Adventures becomes available. If not accepted, The Client will continue on Individual Walks.

  3. The Client will provide all items necessary for pets to be adequately cared for in the client's absence. (i.e., food, medication, leads, tags, collars, etc). In addition, Walkers will be equipped with Easy Walk® Harnesses, leashes, collars with Pawsitive contact information, and other equipment to effectively service clients.

  4. The Client agrees to a minimum of two visits per week, as The Client understands that they are paying to reserve a time. Last minute requests will be accepted if room on the schedule allows, with a $5 Last Minute Request Fee added per visit.

  5. Dog walks to check on pets during a client's vacation absence will not be allowed due to the stress it puts on a dog to be alone, crated, etc. for consecutive long periods of time. VIP 24/7 Pet Sitting will be suggested.

  6. If pets have unsupervised access to the outdoors, Pawsitive Walkers/Sitters shall not be liable for any mishap of any nature regarding the pets.

  7. All dogs being exercised must be fully vaccinated and on a regular flea and worm control regime. Proof must be provided before walking can begin.

Pet Sitting Services

  1. VIP 24/7 Pet Sitting are scheduled as 24/7, with pet sitters required to be at the Client's home from 8:00 pm to 8:00 am. Sitters may leave for errands, appointments, & other dog walking during the day; if none, Sitters will spend free time at the location.

  2. Cat Care Drop-in Services are 30 minutes and are for cats, small animals, horses, cattle, and any other animal Pawsitive Pet Care sees fit, no dogs. Drop-ins are scheduled between 7am-9am and 6pm-8pm only unless otherwise agreed upon.

  3. The Client will provide all items necessary for pets to be adequately cared for in the client's absence. (i.e., food, medication, leads, tags, collars, and other equipment to effectively service clients.)

  4. If pets have unsupervised access to the outdoors, Pawsitive Sitters shall not be liable for any mishap of any nature regarding the pets.

 

Invoices + Payments

Billing

  1. Monthly Dog Walking Services: Invoices are emailed on the 28th of each month for prepayment for the following month. In some cases, special arrangements can be made for off-cycle billing.

  2. Full payment for Monthly Dog Walking Services is to be made by the 5th of each month. Payments for Last Minute Requests are due five days after request is approved.

  3. Monthly Dog Walking Clients are charged a monthly flat rate to reserve their spots on the schedule. This rate is determined by:

    • The number of visits per week, minus

    • Holidays, minus

    • 10 Vacation Days, divided by

    • 12 months.

  4. Monthly Dog Walking Clients may change their service needs for the following month by private messaging Pawsitive through their Client Account in Time To Pet, and they will be charged the appropriate flat monthly rate.

  5. Pet Sitting/Cat Care Services/Hourly Pet Sitting: Invoice is emailed at time of scheduling with a 25% non-refundable deposit due within 48 hours. Remaining balance is due the day before services begin.

  6. Forms of payment accepted include credit/debit, cash, check, and ACH.

  7. The Client is required to keep a card on file in their Time To Pet account before services will be rendered, and agrees to have their cards on file automatically charged by Pawsitive Pet Care on the invoice due date, unless special arrangements have been made.

Late Payments

  1. After 5 days of non-payment, $5 will be added to the total bill for each day that payment is overdue up to 30 days, when at that time services will be terminated.

  2. In the event of a returned check:

    • A $10 fee will apply to the first returned item, in addition to the original check balance.

    • For the second returned item within 3 months, the fee is $25.

    • In both cases, the terms of late payments will apply.

    • The third returned item will constitute a termination of services, a $25 fee, and the terms of late payments will apply.

    3. Cost of Services are subject to change at any time. The Client will be notified of the change by Pawsitive Pet Care in a timely manner.

 

Cancellations

  1. Cancellation notice as early as possible is very appreciated and should be done through the Client Account.

  2. Monthly Dog Walking Clients receive ten Vacation Days per year per dog that will be used for canceling visits, when available.

  3. There are no refunds for cancellations of Monthly Dog Walking Visits because The Client understands they pay for reserving a time slot. After all vacation days have been used, no monetary credit will be added to the client's account for cancellations made.

  4. Pet Sitting Services canceled may be refunded or added as a credit to the client’s account, minus the 25% non-refundable deposit and card processing fees.

  5. In the event that Pawsitive must cancel a monthly dog walking visit due to an emergency or illness, every attempt will be made to have the backup walker take over the visit or reschedule the visits within the same month. If that isn't possible, the visits will be added to the next month's schedule, in addition to the visits they already have.

  6. Pawsitive will give as much notice about vacation plans as possible, but no less than 30 days. In the event of an emergency out of town trip, Pawsitive will give notice immediately.

 

Emergencies + Liabilities

Liabilities

  1. Pawsitive is fully insured for the client’s peace of mind:

    • General Liability Insurance through Pet Sitters Associates:

      • bodily injury,

      • property damage,

      • personal injury,

      • pets lost, stolen, injured, or killed while in our care,

      • loss of keys, & more.

    • Pawsitive cannot be held liable for theft or damage to your property or injury/illness to your pet unless we can be shown to be negligent, and the Insurance only provides coverage when working on an assignment from the company and for the duration and times of the selected service.

  2. It is agreed that it is The Client’s responsibility to also ensure that the property, its contents, and pets are adequately insured throughout the duration of the assignment.

  3. The Client should notify their neighbors and their home insurance company that Pawsitive Dog Walkers/Sitters will be visiting the property in The Client's absence.

  4. Pawsitive Dog Walkers/Sitters hereby accept no liability for any breach of security or loss of or damage to The Client’s property if any other person is given access to the property during each session of Pet Sitting or Dog Walking Services.

  5. Pawsitive Dog Walkers/Sitters are released from all liability that is related to any transporting of the pets to and from any approved walking location, groomers, or veterinary facility for any necessary medical treatment and incurred medical expenses.

  6. Pawsitive Dog Walkers/Sitters are released from all liability of injury to the pets caused by other pets or animals that are not under the control of Pawsitive Dog Walkers/Sitters.

  7. Under most circumstances The Client shall be held liable for all medical expenses and damages resulting from an injury to Pawsitive Dog Walkers/Sitters caused by the pets as well as damage to The Client's property.

  8. Pawsitive will care for your animal as you would, and while every effort will be made to ensure your pet is well looked after in your absence, Pawsitive Dog Walkers/Sitters cannot be held liable for any loss, injury or death to a pet either inside or outside of the home while in our care.

  9. The Client is responsible for any veterinary bills, no matter how they are incurred, while pets are in the care of Pawsitive Dog Walkers/Sitters.

Entry Devices

  1. Pawsitive Dog Walkers/Sitters hereby warrants to keep safe and confidential all The Client’s keys, remote control entry devices, access codes and any other personal items of The Client entrusted to Pawsitive Dog Walkers/Sitters to allow access to The Client's location, and to return all items to The Client at the termination of services or immediately upon request by The Client.

  2. The Client understands they are required to have a key storage lock box for entry keys, if the property allows for such.

  3. Key storage lock box must be large enough to hold a minimum of two sets of keys to the residence in the case of a key becoming lost or broken.

  4. The storage box must have a combination code access with at least four digits.

  5. Any access codes or alarm codes need to be in the Access Instructions section of The Client’s Account before the first day of service.

Emergencies

  1. The Client must provide Pawsitive Dog Walkers/Sitters with the name and contact number of someone capable of making a decision relating to the pets in an emergency. If the contact is not available Pawsitive Dog Walkers/Sitters reserves the right to consult with a veterinary surgeon and then make a decision which is in the best interests of the animal.

  2. The Client must provide Pawsitive Dog Walkers/Sitters the name and contact number of someone local capable of reaching pets in the case of severe weather that prevents Pawsitive from performing care duties.

  3. The Client must provide veterinarian contact for all pets, and provide the veterinarian with permission for Pawsitive Pet Care to bring in pets if needed. Veterinarian should have a payment method on file for The Client. Pawsitive Pet Care is not responsible for any vet bills incurred.

  4. Should The Client be delayed on return, Pawsitive will use their best endeavors to ensure continued coverage following the assignment end date.

 
  • Any notice that is issued under these terms by either The Client or Pawsitive Dog Walking & Pet Sitting may be delivered in writing or by United States postal mail service, registered or certified with the postage prepaid and a return receipt requested.

  • If one or more of the provisions of these terms are to be found invalid for any reason that shall not affect any other provision of these terms. These terms will then exist as if that provision never existed.

  • These terms hereby supersede any other prior understanding, written or oral agreement between the parties listed above regarding the subject matter of these terms.

  • These terms contain the entire agreement between The Client and Pawsitive Dog Walking & Petsitting and no oral representations or modifications shall be put into force except by a written amendment that is agreed to by both parties.

  • If any legal action is brought to enforce or interpret these terms, the prevailing party will be given reasonable attorney’s fees by the other party in addition to any additional relief the other party may be entitled to.

  • These terms may be terminated by either party submitting a written notice to the other party or may immediately be terminated under the following circumstances:

    • If there is a failure to make a required payment when due,

    • in the event of bankruptcy by either party or the failure to make available or deliver the Services in the time and manner as described here.

  • In the event of termination of services, no refunds will be made of any payments already made to Pawsitive.
